2. No data collection by the provider

DeliveryCheck works entirely offline on your iPhone. There is no account, no sign-in, no analytics or tracking tools, no advertising and no third-party SDKs, and the app does not transmit any data to us or to third parties. We have no access to your data.

The app stores the following data locally in the app’s private storage on your iPhone:

This local storage is technically necessary to provide the functions you expressly use (documenting inspections, attaching photos, creating reports) and is therefore permitted without consent (§ 25(2) no. 2 TDDDG). If you enter other people’s data (e.g. the owner’s name), you are responsible for handling it lawfully.

Your data leaves the iPhone only if you share a report yourself (section 3) or if your device backup (e.g. iCloud Backup or a backup on a computer) includes it; your settings and the terms of Apple or the relevant provider apply to that. If you delete an inspection, the app also deletes all related entries and photo files (damage photos and photos attached to checklist notes); you can also delete single photos attached to checklist notes, in which case the app deletes that photo file. Deleting the app removes all of the app’s data from your iPhone; copies in backups and reports you have already shared are not affected.

3. Camera, photos and PDF reports

The app asks for camera access only when you want to take a photo to document damage or (from version 1.1) a defect in a checklist note. You can revoke access at any time in iOS Settings. You choose photos from your library with the iOS photo picker; the app receives only the photos you select and does not otherwise read your library. The app stores a JPEG copy of each photo in its own storage; no location or camera data (EXIF/GPS) is carried over. Photos for damage entries are stored at their original resolution; photos attached to checklist notes are stored in reduced size (at most 2048 pixels on the longer side). Photos are processed on the device and are never uploaded or synced; there is no automatic image analysis.

The app creates PDF reports on your iPhone as a temporary file (iOS may delete temporary files at any time; they are deleted at the latest when you delete the app). A report contains the details of your inspection (including the VIN and – if entered – the owner name), the photos of your damage entries and, as small thumbnails, the photos attached to your checklist notes. The file name contains the VIN if you entered one (“DeliveryInspection-” or, with the app in German, “Uebergabeprotokoll-”, followed by the VIN; without a VIN, “Vehicle” or “Fahrzeug”). A report leaves the device only if you pass it via the iOS share sheet to a destination you choose (e.g. AirDrop, Mail or Files); the recipient or service you choose is then responsible for further processing.

4. Purchase via the App Store

DeliveryCheck is offered as a one-time paid app on the Apple App Store. There are no in-app purchases and no subscriptions. Purchase, download, payment, refunds and updates are handled by Apple (in the EU: Apple Distribution International Ltd., Ireland) as an independent controller; Apple processes, for example, your Apple Account and payment data. We receive neither personal payment data nor your name. See https://www.apple.com/legal/privacy/

If you have turned on “Share With App Developers” in iOS, Apple provides us with crash reports and usage statistics for the app in aggregated or non-identifying form. We use them only to find and fix errors and to improve the app (legal basis: Art. 6(1)(f) GDPR; legitimate interest in an app that works correctly), do not combine them with other data and delete downloaded reports as soon as they are no longer needed for this purpose, at the latest after 12 months. You can switch sharing off at any time in iOS Settings → Privacy & Security → Analytics & Improvements → Share With App Developers.

5. Contacting us

If you contact us by e-mail or phone, we process your name, contact details and the content of your message to answer your request. The legal basis is Art. 6(1)(b) GDPR if your request concerns a contract or pre-contractual steps, otherwise Art. 6(1)(f) GDPR (our legitimate interest in answering enquiries). Providing this information is voluntary, but without it we cannot answer your request. Our e-mails are processed by Zoho Corporation GmbH, II. Hagen 7, 45127 Essen, Germany, as our processor (Art. 28 GDPR) and stored in Zoho's EU data centres (operated by Zoho Corporation B.V., Utrecht, Netherlands). We delete your enquiry 12 months after the conversation has ended unless statutory retention obligations apply.

6. Your rights

Under the GDPR you have the right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and to object (Art. 21), and the right to lodge a complaint with a supervisory authority (Art. 77). The authority competent for us is the Bavarian Data Protection Authority (Bayerisches Landesamt für Datenschutzaufsicht, BayLDA), Promenade 18, 91522 Ansbach, Germany; you may also contact the supervisory authority where you live. As the app does not transmit any data to us, we generally hold no data about your use of the app. We do not use automated decision-making, including profiling (Art. 22 GDPR). We have not appointed a data protection officer because we are not legally required to (Art. 37 GDPR, § 38 BDSG).

Right to object (Art. 21 GDPR): Where we process data on the basis of Art. 6(1)(f) GDPR (sections 4 and 5), you may object at any time on grounds relating to your particular situation. We will then stop processing the data unless we can demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims. An e-mail to info@formaventus.com is sufficient.

7. Not affiliated with Tesla

DeliveryCheck is an independent app and is not affiliated with, endorsed or sponsored by Tesla, Inc. “Tesla” and model names are trademarks of their respective owners.

8. Changes

We will update this policy if the way the app handles data changes. The current version is available at https://bitonapps.dev/privacy/a4/.
