Aktuelle Fassung: https://bitonapps.dev/terms/a4/

1. Provider

Forma Ventus 3D Solutions (sole proprietorship)
Merowingerstraße 3

E-mail: info@formaventus.com

2. Scope and licence
These terms apply to the iOS app DeliveryCheck. The provider grants you a simple, non-transferable licence to use the app on Apple devices you own or control, subject to the usage rules of the Apple Media Services Terms. Apple’s standard Licensed Application End User License Agreement (“Standard EULA”) also applies: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Where they conflict, these terms prevail. Rights in case of defects and liability are governed exclusively by statutory law and section 5; the warranty and liability provisions of the Standard EULA (sections e and f) do not apply in this respect.
3. Service – no guarantee of completeness
DeliveryCheck helps you at vehicle delivery with a checklist, a damage log with photos and a PDF report. The checklist is guidance and replaces neither an expert assessment nor legal advice; a PDF report is your own documentation, not an expert report. The provider does not guarantee that every defect will be found. Your statutory rights in case of defects of the app remain unaffected.
4. Purchase
DeliveryCheck is offered on the Apple App Store; the App Store shows you the current price before you buy. There are no in-app purchases and no subscription. Your contractual partner for the purchase is Apple (in the EU: Apple Distribution International Ltd., Ireland); purchase, payment, withdrawal and refunds are handled by Apple under Apple’s terms. Consumers in the EU may withdraw from their purchase within 14 days in accordance with the Apple Media Services Terms, e.g. via reportaproblem.apple.com. Your statutory rights as a consumer remain unaffected.
5. Liability
The provider is liable without limitation for intent and gross negligence, for injury to life, body or health, for fraudulent concealment of a defect, to the extent of any guarantee given, and under the German Product Liability Act. For slightly negligent breach of essential contractual obligations – obligations whose fulfilment makes the proper use of the app possible in the first place and on which you may regularly rely – liability is limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.
6. Your data
Your data is stored on your iPhone; the app does not transmit any data to the provider. It leaves the device only if you share a report yourself or if your device backup includes it. Details: https://bitonapps.dev/privacy/a4/
7. Not affiliated with Tesla
DeliveryCheck is an independent app and is not affiliated with Tesla, Inc.; “Tesla” and model names are trademarks of their respective owners.
8. Applicable law
These terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not take away the protection of the mandatory consumer law of the country in which you have your habitual residence.
9. Changes
The provider may update these terms for the future. Agreements already made with you do not change without your consent; mandatory statutory rights remain unaffected. Current version: https://bitonapps.dev/terms/a4/
